Gerard Kennedy is a Principal of Macpherson+Kelley Lawyers. He has practiced commercial law for over 30 years, specialising in business corporate law and international trade law.
Gerard’s principal areas of expertise are business sales and acquisitions, documenting all business and trade contracts and arrangements including terms and conditions of supply and purchase, distribution, agency, joint venture, confidentiality, license, shareholder, leasing, employment agreements, tender contracts and the like, shareholder disputes, providing Corporations Law advice, advising directors and boards on all corporate matters including corporate governance and compliance, Shariah mortgage fund expertise.
Gerard’s Shariah Experience includes being the primary Australian academic behind:
• The Memorandum of Understanding which enables agreements to comply with both Shariah Principles and Australian Law
• Changes to the Duties Act in Victoria to abolish double stamp duty because of dual ownership
• The developoment of products in Australia incorporating the Shariah principles of:

- Mudharaba
- Musharaka
- Murabaha
- Ijara Muntahiya Bittamleek
- Ijara Waiktina
Gerard is Accredited Specialist in Business Law a member of the Victorian Lawyers RPA Ltd, the International Trade Section of the Law Council of Australia, the Commercial Law Section of the Law Institute of Victoria, and is an accredited member of the Australian Compliance Institute. Gerard is also a former member of the Business Law Advisory Committee of the Law Institute of Victoria.
